“Golden Temple claims they’ve ceased using all marks under the license a year ago,” Soni said. “We’re taking the position that if that’s true, then any continued use of the trademarks after that time is an infringement because they terminated their agreement, and certainly expansion of the use of ‘Yogi’ to cereal products is an infringement.”

Yogi Bhajan’s widow is seeking an order to stop Golden Temple from using the trademarks covered by the license. She wants the trademarks that Golden Temple has registered with the U.S. Patent and Trademark Office, in violation of the licensing agreement, transferred to the proper owner, Soni said. She also is seeking damages, including profits generated from Golden Temple’s unauthorized use of the trademarks, he said.
